Following the biopsy error, Ms. Aanya experiences prolonged discomfort, complications and requires additional medical interventions and care. Unsatisfied with the outcome, Ms. Aanya decides to pursue legal action against Dr. Patel, citing medical negligence and seeking compensation for the damages she has endured.


In this scenario:


The triggering event for Dr. Patel's Doctor Indemnity Insurance occurs when Ms. Aanya files a claim, alleging professional negligence. Dr. Patel promptly informs his insurance provider about the claim, initiating the claims process.


The Doctors Professional Indemnity Insurance coverage is now in effect, prompting the insurer to investigate the claim and assess its validity. Doctors Indemnity Insurance Policy - Limit of Indemnity

The insured amount in professional indemnity insurance is termed as the Limit of Indemnity. This limit is specified per accident and per policy period, denoted as Any One Accident (AOA) limit and Any One Year (AOY) limit, respectively.


The insured can choose the ratio of the AOA limit to the AOY limit. The AOA limit, representing the maximum payout for each accident, needs to be predetermined. The table below outlines various ratio options for the AOA limit to the AOY limit, explaining their meanings and providing examples:

1:1 Full sum insured for any one claim. If the insured has a sum insured of Rs. 1 Crore and a claim arises during the policy tenure, coverage extends up to Rs. 1 Crore for one claim.
1:2 Maximum 50% of the sum insured for any one claim. If the insured has a sum insured of Rs. 1 Crore and a claim arises, coverage is up to Rs. 50 Lakh for one claim and an additional Rs. 50 Lakh for another claim.
1:3 One-third of the sum insured for any one claim. If the insured has a sum insured of Rs. 1 Crore, coverage is up to Rs. 33.33 Lakh for one claim and Rs. 33.33 Lakh for two more claims.
1:4 25% of the sum insured for any one claim. If the insured has a sum insured of Rs. 1 Crore, coverage is up to Rs. 25 Lakh for one claim and Rs. 25 Lakh for three more claims.

Note 1: Determining the AOA limit involves factors like the insured's activity nature, potential affected individuals, and potential property damage in the worst-case accident.

Professional Indemnity Insurance for Doctors: Eligibility Criteria

  • Individual doctors can apply
  • Applicant should have zero claim history
  • Preferred Qualification: MBBS, BPT, BDS, BAMS, BHMS, MD, MPT MDS, MS or higher.

Note: Plastic Surgeons and Cosmetic Surgeons are not eligible for Medical Indemnity Insurance** subject to the insurer. 

Doctors Professional Indemnity Insurance Claim Process

Follow the steps below to raise the claim under Medical Indemnity Insurance for Doctors:

  1. Claim Intimation: Immediately inform your relationship manager about the incident.
  2. Generation of Claim Reference Number: Your relationship manager will help you register the claim and provide you with a claim reference number from the insurance company. 
  3. Documentation: Your relationship manager will provide you with a required list of documents. Please ensure to submit them promptly for sharing with the insurance company.
  4. Claim Settlement Assistance: Your relationship manager will assist you throughout the claim settlement process.
